Are Upside Down Mortgages a Modern Day Debtor’s Prison? We all know Debtor’s Prison didn’t work. In fact, Debtor’s Prison was a solid drag on the economy. Here is why.
A person would go into debt. If he couldn’t repay the debt, his creditor could have him thrown into prison. Here is the problem with that logic. Someone who does have ability to go to work every day can’t afford to repay you. Will they be able to repay you after they get thrown in jail?
Remember, most people in jail do not have a job! Here is the other way that Debtor’s Prison drags on an economy. It discourages people from taking risks. Who is going to start a new business? I wouldn’t start a new business if for any reason if failed, then I would be carted off to prison! Who would buy a new house, unless they were paying cash?
“You can’t repay your upside down mortgage. It’s off to debtor’s prison with you”, the banker says. Everyone, including the banks, got hurt by the recent housing bust. But, most banks got a bailout. I know of a local bank that got 6 million dollars in bailout money.
That’s a lot more bailout than any of their customers received. Where’s the little guy’s bailout? This is why, in my opinion, you shouldn’t be ashamed that you want no deficiency after a short sale. It is also why I work hard to make sure that our short sale customers don’t get stuck with a deficiency.
I won’t judge you if you are upside down on your house and want to short sale. I’ve seen so many hardworking people who are forced to sell because they can’t afford their high house payment. Their lender was so eager to give them the loan. Now that they are losing the house, the lender doesn’t care. They simply “sic” the debt collectors on them.
